Long story short, a guy ran his car off the road into my front yard and hit a tree. The tree is a complete loss. He has insurance (thank god!). How much should I expect to receive from the insurance company for the value of the tree? The tree is a mature Blue Spruce. It was about 20-25 feet tall, had an 8-10 inch trunk, and a spread at the base of about 15 feet or so. I know that I should at least be entitled to the cost of removing the tree/debris and planting a new tree. But you cant really plant a 25 foot Blue Spruce! So, the problem I am having is determining what value should I be entitled to considering the maturity of the tree? Who can I call to get an appraisal? Other info: I live in a subdivision of custom brick homes on a large lot (about 1 acre) and my home is worth about $275k. So I was in a car accident recently, pretty minor, but the damage to my car exceed the value of my car by A LOT Damage total $2500. Car 91 integra, not worth 2500 anymore. First question in an accident were the at party person assumes responsibility of the car and both parties decide to not go through insurance both parties have to come to an agreeable amount right? Second- If the party not at fault is not happy with the agreed amount and decided to go through insurance instead, but the damage exceeds the value of the victims car, is the responsible parties insurance going to pay out the amount of the damage done, I got 4 estimates or it the insurance going to pay only the value of the car and salvage my title? Second, can the responsible party pay out the amount that is agreed upon and then expect to get the victims (my) car in return? Or is his considered extortion? Cause there is no f-in way I the person who is not responsible for the accident can find a reliable car for 1500 bucks, but could part out, or retire my car, sell my car and get more plus the 1500 she agreed upon. I am afraid that if insurance is involved they are going to total my car out thus costy me hundreds more, then it will be worth nothing and I would not be able to retire it and get money from that or even sell it. Lastly, this person has no right to ask me for my car right, she caused the accident and is responsible for paying for that damage that she cause one way or another. Please help me figure this out.

Accident Advice - Car without insurance?

My friend was driving her car on a busy highway, minding her own business. Suddenly a large SUV hits her rear quarter and pushes her off the road, down a hill, and into a ditch. Apparently, and there were about 10 witnesses to the situation, the driver who hit her was involved in some sort of road-rage war for about 5 miles, ending when she hit my friend's car. My friend is ok, but her insurance had expired on her car. The police didn't ask for her insurance that day. She learned a lesson and has since payed up online, so the insurance co doesn't know about the accident. Both of the drivers involved in the road rage were charged with reckless driving, and one of them even got arrested. Our question is this: she has $1400 in damage to her vehicle. She is willing to pay what she needs to pay to get her car out, just to avoid getting in trouble for driving without insurance. Are there any other options for her?
